Purpose: 

The purpose of this policy is to establish guidelines on when it is required for University of Wisconsin-Platteville Police Officers to fingerprint and photograph arrested subjects.

Policy:

All University of Wisconsin-Platteville Police Officers shall properly book (fingerprint, photograph, obtain identifying information) arrested subjects for all, but not limited to the crimes listed in the procedures section below, in accordance with Wisconsin State Statutes §165.83, §165.83(2) and §165.84.

Procedures:

  1. In reference to Wisconsin State Statutes (§165.83 and §165.84) all persons in charge of Wisconsin law enforcement agencies must obtain, or cause to be obtained, fingerprints, descriptions, photographs, and other available identifying data on persons who have been arrested or taken into custody pursuant to §165.83(2)
    1. For an offense which is a felony
    2. For an offense which is a misdemeanor or a violation of an ordinance/ UWS Chapter 18 involving:
      1. Burglary tools
      2. Commercial gambling
      3. Dealing in gambling devices
      4. Contributing to the delinquency of a child
      5. Dealing in stolen property
      6. Controlled substances under Chapter 961
      7. Firearms
      8. Dangerous weapons
      9. Explosives
      10. Pandering
      11. Prostitution
      12. Sex offenses where children are victims
      13. Worthless checks
      14. An offense charged as disorderly conduct, but which relates to an act connected with one or more of the above listed offenses
      15. A fugitive from justice
      16. §940.32 Stalking
      17. §947.013 Harassment
  2. It is not unusual for the University Police to request a criminal complaint for an incident, and the Officer did not have actual contact with the suspect let alone actually arrest or take the individual into custody.  In the event a situation like this occurs
    1. The Police Officer requesting the criminal complaint will complete an incident report and forward that report, DA Protect Sheet, and all attachments to the District Attorney’s Office.  Anyone who is summoned or issued a citation for a mandatory offense shall be ordered by the judge at the initial appearance to be fingerprinted and photographed in accordance with §970.02(7).
  3. Required Fingerprint Cards
    1. Crime Information Bureau Finger print Card (Green cardboard card)
      1. This card should be completed for anyone arrested or charged with an offense listed on the first page.  In the event that the person is not taken into custody by the officer involved, the judge will be required to order the person to be fingerprinted and photographed by the Sheriff’s Office.  The Sheriff’s Office will need to be provided with our ORI:
        1. UW-Platteville Police ORI: WI0221400
      2. A copy of the CIB fingerprint card is attached (Appendix A “Front”), with the areas that are required to be completed.  It should be noted that this card may contain as many as four separate charges or citations listed in the “Charge/Citation Literal” section.
      3. “Residence/ Complete Address” requires an actual physical address. 
        1. PO Boxes are not acceptable. 
        2. For students, use their permanent address, not their local school address. 
        3. For an individual who is homeless, the section should be left blank.
      4. Do not forget to have the subject sign the back of the card (Appendix B “Back”).  This is mandatory.  If the person refuses to sign the card, write “refused” in this section.
    2. Final Disposition Report Card (Green paper card) (Appendix C )
      1. The Final Disposition Report (DJ-LE-249) is the information gathering tool that the Crime Information Bureau uses to track criminal history information on anyone arrested in the State of Wisconsin.  It is extremely important that the arresting officer complete a Final Disposition Report for each offense an individual will be charged with.
        1.   Unlike the CIB card, the Final Disposition Card requires a separate card for each offense, in the case of a multiple offense case.
      2. The original Final Disposition Report (FDR) will be forwarded to the District Attorney’s Office.  A copy of each FDR should be included with the case report as evidence that the FDR was completed.
      3. Again, the ORI for the University of Wisconsin-Platteville Police Department is: WI0221400.
      4. Attached (Appendix C) is the FDR card showing the areas that must be completed.
    3. FBI Fingerprint Cards (blue)
      1. These can be found at the City of Platteville Police department and should be used for felony cases.
      2. Complete the same information as you would on the CIB card.
    4. Fingerprinting Location
      1. It is recommended that the arresting officer transport the suspect to the City of Platteville Police Department’s secured booking facility to obtain fingerprints and photographs.
        1. You will need to request a copy of the digital photograph from the City of Platteville in either digital format, or a printed copy.
      2. If the suspect is heading directly to the Grant County Jail, the jail staff will fingerprint and photograph the suspect at their facility.
